1. Introduction and Acceptance of Booking Terms & Conditions

Welcome to Atoll Discovery, operated by Atoll Discovery Pvt. Ltd., a company registered under the laws of the Republic of Maldives (hereafter "Atoll Discovery," "We," "Us," or "Our").

Atoll Discovery provides an online platform that facilitates the search, selection, and booking of accommodation and travel packages in the Maldives (the "Services"). By accessing, browsing, or using Our website (www.atolldiscovery.com) or Services, You ("User" or "You") agree to be bound by these Terms of Service, all applicable laws, and regulations. If You do not agree with any part of these Terms, You must not use Our Services.

2. Atoll Discovery's Role as Intermediary

Atoll Discovery acts solely as an intermediary, or booking agent, between You and the third-party providers of travel services, including but not limited to hotels, resorts, guesthouses, transfer providers (seaplane, speedboat, domestic flight), and other service operators (the "Service Providers").

We do not own, manage, or operate any of the accommodations or travel services listed on Our website.

Your booking constitutes a contract between You and the specific Service Provider. We are not a party to that contract, nor are we liable for the provision of the booked services.

Information regarding accommodations, rates, and availability is provided to Us by the Service Providers. While we strive for accuracy, We cannot guarantee that all information is free of errors or omissions.

3. Booking and Reservation

3.1. Accuracy of Information: You warrant that all personal, contact, and payment information provided during the booking process is complete, accurate, and current. You are responsible for ensuring that all names on the booking match the names on the corresponding travel documents (e.g., passport).

3.2. Booking Confirmation: 

A booking is considered confirmed only when You receive a formal Booking Confirmation email from Atoll Discovery. This email will include the Service Provider’s name, full reservation details, and a unique confirmation number.

a) Right of Cancellation (Pre-Confirmation): Until a confirmation is formally issued, We reserve the right to cancel the reservation for any reason, including system technical error, pricing inaccuracies, or Service Provider overbooking.

b) Post-Confirmation Cancellation (Supplier Overbooking): In the unlikely event that a confirmed reservation cannot be honored by the Service Provider (e.g., due to overbooking, withdrawal of availability, or Force Majeure), We reserve the right to cancel the reservation. We commit to notify You of any such cancellation within a maximum period of 7 days after the booking confirmation has been issued. Upon becoming aware of the issue, we will notify You and process the required full refund within next 7 days. This full refund shall constitute Our sole liability to You. We will make reasonable efforts to offer comparable alternative accommodation if available.

3.3. Transfers: All international and inter-island transfers (seaplane, speedboat, or domestic flight) are typically arranged by the Service Provider and are often mandatory. Any costs associated with these transfers, whether included or excluded from the package price, will be clearly indicated during the booking process. You are required to provide flight arrival and departure details accurately and promptly to facilitate these arrangements.

4. Pricing and Payment

4.1. Pricing: All prices are displayed in USD (or other selectable currencies) and include all mandatory government taxes, service charges, and fees, unless explicitly stated otherwise (e.g., separate green tax or transfer fees).

4.2. Payment Policy: 

Full payment is generally required at the time of booking to secure the reservation, unless a specific Service Provider offers a flexible payment schedule (e.g., a deposit or "Pay on Arrival" option).

Settlement of "Pay on Arrival" Amounts: If the booking confirmation or payment receipt explicitly states a remaining balance as "To be Paid on Arrival," You acknowledge and agree that this amount must be settled immediately upon arrival at Velana International Airport (MLE) with the designated Atoll Discovery representative or the Service Provider's representative. The timely settlement of this outstanding balance is mandatory and essential to arrange and confirm your seamless transfer (seaplane, speedboat, or domestic flight) to the booked hotel or resort. Failure to settle the due amount may result in delays or cancellation of transfer arrangements, for which Atoll Discovery shall not be liable.

4.3. Secure Payment Processing: We accept major credit cards, debit cards, and digital payment methods, including those processed securely via Stripe and PayPal through our secure payment service provider Flywire. Your financial data is handled directly by these secure payment gateways, and We do not store sensitive card information on Our servers.

4.4. Fraudulent Payments: We reserve the right to cancel any booking if We suspect the payment is fraudulent or unauthorized. In such cases, You will be liable for any associated fees incurred by Us or the Service Provider.

5. Cancellations, Amendments, and Refunds

5.1. Property-Specific Policies: Cancellation and amendment policies are set by the individual Service Provider (hotel or resort) and vary for each booking. By confirming a booking, You acknowledge and agree to the specific cancellation terms applicable to that reservation.

5.2. Request Process: All requests for cancellations or amendments must be submitted to Atoll Discovery in writing (via email). The date of receipt of the written request will determine the applicable policy.

5.3. Refunds: Refunds, if applicable based on the Service Provider’s policy, will be processed by Atoll Discovery after they are received from the Service Provider. Please note that banks, credit card issuers, and payment processors (Stripe/PayPal) may take time to process the refund, which is beyond Our control.

5.4. Force Majeure: Atoll Discovery shall not be liable for any failure to perform Our obligations if such failure is caused by acts of nature, war, terrorism, government restrictions, pandemic-related events, or any other event beyond Our reasonable control.

6. Liability and Indemnity

6.1. Limitation of Liability: To the maximum extent permitted by law, Atoll Discovery shall not be liable for any personal injury, death, property damage, or other loss or expense, including direct, indirect, special, or consequential damages, arising from the use of the Services or the failure of the Service Provider to provide the booked services. Our liability, if any, shall be limited to the total amount paid by You for the specific booking in question.

6.2. Indemnity: You agree to indemnify and hold harmless Atoll Discovery and its officers, directors, and agents from any loss, liability, claim, or demand arising out of Your use of the website or violation of these Terms.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Maldives. You agree to submit to the exclusive jurisdiction of the courts of the Maldives for the resolution of any disputes arising out of or relating to these Terms or Your use of the Services.
